Urgent Tech Glitch Delays Pollution Certificates for Challaned Vehicles
Vehicles with pending traffic challan compliance in Guwahati are currently unable to obtain Pollution Under Control Certificates (PUCC) due to software deficiencies, as stated by the state transport department. This issue was highlighted during a court hearing of a petition filed by the Metropolitan Transports Association and Manoj Kumar Thakuria. The court acknowledged amendments made by the Ministry of Road Transport and Highways in September 2020 to the Central Motor Vehicle Rules of 1989. One such amendment stipulates that if a challan is overdue, applications related to the licenses of the offenders or the registration of vehicles under the challan cannot be processed, except for applications concerning permits, fitness, and motor vehicle taxes.
Essentially, the court indicated that these amendments are designed to enforce compliance with traffic challans. During the period that a challan remains unresolved, no registration for the vehicle mentioned in it or renewal of the offender’s license can occur. Despite this, the court noted that a vehicle requires various other certificates, including the PUCC, to operate on the roads. Petitioners argue that PUCCs are not being issued while the challan compliance is pending, and the court indicated that the software developed by the National Informatics Centre (NIC) fails to capture the PUCC certification.
In May of the previous year, the Ministry of Road Transport clarified that there are no legal restrictions against issuing PUCCs to vehicles with fines. States and union territories were instructed to implement the updated PUCC software version 2.0. The court, presided over by Chief Justice Ashutosh Kumar and Justice Michael Zothankhuma, stated that the amended rules do not prevent the issuance of a PUCC while challan compliance is pending. Deputy Solicitor General RKD Choudhury noted he would seek further instructions and return to the court on the next date, with the hearing scheduled for August 14.
