Urgent Action Required: Supreme Court Tackles D.Y. Chandrachud’s Appeal!

The Supreme Court administration has sent a letter to the central government requesting the evacuation of the residence of former Chief Justice D.Y. Chandrachud. Notably, the former Chief Justice has continued to occupy this residence even after retirement.

In the letter, the Supreme Court administration indicated that the deadline for Justice Chandrachud to reside in the bungalow has expired. It also mentioned the necessity of vacating the bungalow to return it to the court’s housing pool.

This correspondence was forwarded to the Ministry of Housing and Urban Development on July 1. The central government is being urged to expedite the evacuation of Bungalow No. 5, located on Krishna Menon Marg in Lutyens’ Delhi. This bungalow is officially designated as the residence for the current Chief Justice of the Supreme Court.

The letter to the government specifies that Justice D.Y. Chandrachud must vacate Bungalow No. 5 with immediate effect. The authorization for his occupancy was set to end on May 21, 2025. Furthermore, under Rule 3 of the 2022 regulations, the six-month occupancy limit closed on May 10, 2025.

An official from the Supreme Court mentioned this in the letter sent to the Ministry of Housing and Urban Development. Justice Chandrachud served as the 50th Chief Justice of India from November 2022 to November 2024. Even eight months after his term ended, he is still residing in the Type VIII bungalow.

At the same time, sitting Chief Justice Sanjiv Khanna and the current Chief Justice Bhushan R. Gavai have not moved into the official residence, as both are currently residing in their allotted bungalows.

In an interview with Hindustan Times, Justice Chandrachud referred to his personal circumstances and clarified that the Supreme Court administration is fully aware of the situation. He pointed out that the government has already arranged temporary accommodations for him on a limited basis. However, he noted that the prolonged disuse has rendered the space unsuitable for habitation.
