Delhi HC Set to Deliver Groundbreaking Judgment on Celebi’s Security Clearance Order Tomorrow: What You Need to Know!

The Delhi High Court is set to announce its judgment on the cancellation of security clearance for Celebi Aviation Holding, a Turkish ground handling and cargo operations company, following a challenge against the Union government’s decision. This critical ruling is anticipated tomorrow, July 7, as the firm contends that the revocation is tied to national security concerns in the wake of the Pahalgam terror attack.

In a May 21 hearing, Celebi argued that the Indian government’s choice to revoke its security clearance, particularly after Turkey’s support for Pakistan during regional tensions, undermined the principles of natural justice and severely impacted its operations in India. Senior counsel Mukul Rohatgi stated, “Our business and contracts have been affected,” highlighting that numerous contracts with airports nationwide were falling through post-cancellation. Celebi emphasized its identity as an Indian company-asserting that all employees are Indian nationals-and urged the court to overturn the security clearance revocation.

On the government side, Solicitor General Tushar Mehta defended the Centre’s decision during the May 22 hearings, asserting that the government possesses “plenary powers” essential for safeguarding national security. He pointed out the potential risks associated with ground handling companies, which operate in sensitive areas like airports and aircraft. “Plenary powers rest with the government to avoid any potential threat to the country,” Mehta argued, underscoring the delicate interplay of civil aviation and national sovereignty.

The background to this case traces back to May 15 when the Bureau of Civil Aviation Security (BCAS) revoked Celebi’s security clearance, affecting operations at nine major airports, including Delhi and Mumbai. This action followed rising public sentiments advocating for a boycott of the Turkish firm in light of Turkey’s recent geopolitical stance.

In response to the backlash, Celebi sought to clarify misconceptions surrounding its ownership structure. The company refuted claims linking it to Sümeyye Erdoğan, the daughter of Turkish President Recep Tayyip Erdoğan, clarifying that she holds no stake in the firm. Celebi detailed that the company’s ownership comprises just Can and Canan Celebioglu, each owning 17.5%, without any political affiliations. Moreover, 65% of Celebi’s parent organization is owned by international institutional investors, reinforcing its commercial independence.

As judgment day approaches, all eyes are on the Delhi High Court, where the ruling could significantly impact Celebi Aviation’s operations in India, amidst rising tensions over national security and foreign affiliations. The implications of this case extend beyond mere corporate interests, touching on the broader themes of national security and international relations.
