Urgent Plea to HC: Enforce Supreme Court Guidelines for Safer Court Security Now!

In a troubling incident at the Madurai District Court, two brothers were arrested after causing chaos following their conviction for possession of ganja and threats made against the presiding judge. The incident has raised serious concerns regarding court security, prompting a discussion before the Madurai Bench of the Madras High Court. Judge P. Velmurugan and Justice K.K. Ramakrishnan ordered a notice to be issued to the State in light of a public interest litigation filed by Advocate M. Pozhilan from Madurai.

The petitioner highlighted the alarming behavior of the convicts, Pandiyarajan and Prasanth, who reacted violently to their sentencing by smashing windowpanes in the courtroom and verbally assaulting the judge. Law enforcement quickly intervened, taking the brothers to Government Rajaji Hospital for treatment before transferring them to Madurai Central Prison.

This incident underscores the growing vulnerability of judicial proceedings, where judges and lawyers are increasingly at risk. The petitioner emphasized the urgent need for implementing established security measures, citing the Supreme Court’s guidelines on court safety, which recommend comprehensive security plans, the establishment of permanent court security units, and the installation of CCTV cameras, among other precautions. Despite these recommendations, the recent turmoil indicates that existing safeguards are either not effectively enforced or grossly insufficient.

Advocate Pozhilan pointed out the frequency of security lapses throughout the State, jeopardizing the safety of witnesses, legal representatives, judges, and even court documents. He urged that strong security protocols must be not only established but strictly adhered to in order to avert further incidents. “If such disturbances continue, it could have dire repercussions. The confidence and courage that judges rely on in administering justice may be undermined, making them apprehensive in performing their duties,” he stated.

The incident has sparked a conversation around the necessity of bolstering court safety measures to ensure that legal proceedings can be conducted without fear of violence or intimidation. With numerous instances of inadequate security reported previously, the urgency of addressing these vulnerabilities has never been clearer.
