President Biden unveiled a comprehensive proposal on Monday aimed at restructuring the Supreme Court, highlighting 18-year term limits for justices and the implementation of a binding code of conduct. According to Biden’s plan, a new Supreme Court justice would be appointed every two years. This reform could have significantly altered the Court’s ideological balance over the past two decades. A hypothetical chart illustrates that if this term-limit policy had been in place, the current conservative majority would now be a liberal majority. Presently, the Court consists of six conservative justices, appointed by former Presidents Donald J. Trump, George W. Bush, and George H.W. Additionally, Biden suggested a constitutional amendment to counter a recent Supreme Court decision affirming substantial immunity for presidents from criminal prosecution.
Despite the bold vision, these changes face significant hurdles. The proposals would necessitate congressional approval, a challenging prospect given the Republican-controlled House and a divided Senate. Consequently, while the proposal sets forth a transformative vision for the Supreme Court’s future, it is unlikely to be realized in the near term.
