Breaking: Supreme Court’s Empowering Decision Eases GRAP-IV Restrictions – A Breath of Relief with GRAP-II Flexibility!
The Supreme Court has decided to modify the air quality restrictions in Delhi, lifting the stringent Stage-IV measures of the Graded Response Action Plan (GRAP) to the less strict Stage-II. This adjustment follows a notable improvement in Delhi’s Air Quality Index (AQI), which has remained consistently below 300 since November 30, according to submissions made by Additional Solicitor General Aishwarya Bhati. The decision was made by a bench comprising Justices Abhay S. Oka and Augustine George Masih, who reviewed the AQI data reflecting a favorable downward trend.
While easing the restrictions, the court has recommended that the Commission for Air Quality Management consider integrating certain measures from GRAP-Stage III as a safeguard. This comes as a directive to be proactive, stipulating the reintroduction of GRAP-III measures if the AQI rises above 350, and reinstating the strict GRAP-IV protocols should the air quality deteriorate beyond 400.
This latest development is a shift from the court’s earlier stance on maintaining GRAP-IV restrictions, a move they had deemed necessary until a clear and consistent decline in air pollution was observed. The transition to GRAP-Stage II aims to balance easing public restrictions while maintaining readiness to tackle any potential air quality deterioration. The court’s decision reflects an ongoing commitment to ensuring both public health and regulatory adaptability in response to real-time environmental data.
