Urgent Resolution: Gauhati High Court Commands Swift Action on Haj Pilgrims’ Refund Plea – Relief in 90 Days!
The High Court has addressed a writ petition from Haj pilgrims in Assam concerning the non-refund of excess airfare for Haj 2023. The pilgrims argued that they were overcharged, paying Rs 3,82,297 per person, which included Rs 1,54,694 for a chartered flight from Guwahati to Jeddah. However, they were instead flown on standard passenger flights, not the promised chartered service.
The petitioners accused the Haj Committee of India of improper cancellation of the chartered flights, leading to unwarranted charges. They claimed that despite repeated requests for a refund submitted to the Chief Executive Officer of the Haj Committee, no action had been taken, necessitating their appeal to the court for resolution.
In court, legal representatives from both sides agreed that the issue could be settled by having the Haj Committee process the refund requests per Section 42 of the Haj Committee Act, 2002. Accepting this approach, the High Court ordered the Haj Committee to address the grievances within 90 days, mandating a detailed response after reviewing the pilgrims’ claims.
The court’s directive aims to ensure a prompt and fair settlement, closing the current legal proceedings on the matter.
