AAP to Challenge BJP’s Victory in MCD Election, Citing Legal Violations
In response to the Bharatiya Janata Party’s (BJP) success in the Municipal Corporation of Delhi (MCD) standing committee election, Chief Minister Atishi of the Aam Aadmi Party (AAP) declared intentions to pursue legal action against the BJP. Atishi labeled the election as "illegal and unconstitutional."
On Friday, BJP candidate Sunder Singh secured the lone vacant seat without opposition, after AAP’s Nirmala Kumari received no votes due to a boycott by both AAP and Congress. Atishi criticized the election process, arguing it breached the Delhi Municipal Corporation Act of 1957.
“The MCD election that the BJP has carried out is illegal, unconstitutional, and undemocratic,” Atishi stated. She explained that the act mandates elections to occur during Corporation meetings, with the mayor holding exclusive authority over the timing and location. "If the mayor is absent, then the deputy mayor presides," she added, highlighting procedural lapses in the recent election.
Atishi also condemned the role of the Delhi Lieutenant Governor (LG), asserting that the LG lacks the jurisdiction to mandate elections but continues to interfere with MCD operations. "This is not the first time this has happened; this is BJP’s standard operating procedure," she claimed, alluding to alleged electoral manipulations in other states.
Reaffirming AAP’s commitment to democratic principles, Atishi announced the party’s decision to file a petition in the Supreme Court to contest the election results. "We will definitely go to the Supreme Court against this undemocratic election," she emphasized, stressing the party’s dedication to the rule of law and accountability.
