Jantar Mantar Protest: Delhi Police File 3 FIRs; CJP Sets Oct 10 Rally
New Delhi: Delhi Police registered at least three first information reports in connection with Friday’s attempted gathering at Jantar Mantar, where student groups, political parties and civil society activists demanded the resignation of Chief Election Commissioner Gyanesh Kumar. Two FIRs were filed at Parliament Street Police Station and one at Connaught Place Police Station.
A senior police officer said the cases were registered under Section 223 of the Bharatiya Nyaya Sanhita, which pertains to disobeying an order lawfully issued by a public servant. No individual or organisation was named as an accused, although the FIRs reportedly contain details of the organisers and groups that proposed or participated in the demonstrations.
Police said the protesters violated prohibitory orders imposed across New Delhi district under Section 163 of the Bharatiya Nagarik Suraksha Sanhita. The restrictions, notified nearly three hours before the planned protest, prohibited gatherings of five or more people, processions, demonstrations, picketing, dharnas, slogan-shouting and speeches without prior written permission.
Under Section 223, disobeying such an order can attract up to six months’ imprisonment, a fine of up to Rs 2,500, or both. If the disobedience causes or is likely to cause danger to human life, health or safety, or leads or is likely to lead to a riot or affray, the punishment may extend to one year, a fine of up to Rs 5,000, or both, according to police.
The protest was related to allegations concerning the Election Commission’s Special Intensive Revision, or SIR, of electoral rolls. The Commission’s response to the allegations was not detailed in the FIRs.
The Cockroach Janta Party said on Saturday that it would hold another peaceful protest at Jantar Mantar on October 10 if Kumar did not resign. Party founder and convener Abhijeet Dipke said, “If Gyanesh Kumar doesn’t resign, cockroaches from across India will march to Delhi and protest at Jantar Mantar on October 10.” He said the organisation would continue its campaign concerning electoral processes and the SIR exercise.
Nearly 1,000 people were detained on Friday from Jantar Mantar and surrounding areas as police and paramilitary personnel prevented large groups from reaching the protest site. Many were later released. Those detained included AAP leaders Saurabh Bharadwaj, Atishi, Sanjay Singh, Kuldeep Kumar, Jarnail Singh and Sanjeev Jha; AISA president Neha Bora; activist Yogendra Yadav; RJD MP Manoj Jha; CPI MP P. Sandesh; Indian Youth Congress president Uday Bhanu Chib; NSUI president Vinod Jakhar; and DYFI president A. A. Rahim.
