HC Rejects Shyamkanu Mahanta’s Bail: Crucial Witness Exam June 8
Gauhati High Court on May 29, 2026 rejected the bail application of Shyamkanu Mahanta, marking the second time his plea for release has been denied in connection with the Zubeen Garg death case. The decision follows an earlier refusal by a fast-track court, delivering another blow to Mahanta’s attempts to secure interim freedom while legal proceedings continue.
Special Public Prosecutor Ziaul Kamar told reporters that the defence remains free to seek remedies in higher courts, including the Supreme Court. “Today, the court of Mitali Thakuria rejected the bail application of Shyamkanu Mahanta. Approaching the Supreme Court is the right of every individual. Those who have the means and resources may choose to challenge the order before the apex court,” Kamar said, adding that government instructions will determine who might represent the matter if it reaches the top court.
Kamar said the prosecution has not yet received a copy of the detailed order and therefore could not comment on the specific grounds for the court’s rejection. “As of now, we have not seen the court order. Once we receive it, we will be able to examine the reasons recorded by the court for rejecting the bail application,” he said.
The prosecutor also noted that another accused, identified as Siddharth, has filed a bail petition, but that matter has not been listed for hearing. Kamar said the immediate focus will now shift to the trial stage, where witness testimony and documentary evidence will be decisive.
The next hearing is scheduled for June 8, 2026, when witnesses are expected to be called for examination. “This is only one stage of the proceedings. The more significant phase is the trial itself, during which the court will hear witnesses, evaluate the evidence placed on record and thereafter arrive at a final decision,” he said.
Addressing questions about Non‑Resident Indian (NRI) witnesses, Kamar said they will be summoned during the trial and their statements recorded according to legal procedures. “Witnesses residing in Singapore will be summoned through the appropriate diplomatic channels and embassy. They will be required to appear and give their statements,” he added, expressing confidence that overseas witnesses will cooperate and warning that the court may issue warrants if any witness fails to respond to summonses.
