AAP Threatens Court Action Over Merger of 7 Rajya Sabha MPs with BJP
New Delhi, April 27: The Aam Aadmi Party (AAP) said on Monday it will move the courts if seven of its former Rajya Sabha MPs are not disqualified under the anti-defection law after the Rajya Sabha Chairman accepted their merger with the Bharatiya Janata Party (BJP).
Reacting to the Chairman’s decision, AAP Rajya Sabha MP Sanjay Singh said the seven MPs had submitted a letter seeking recognition of their merger with the BJP, which the Chair accepted. Singh said the party’s objections and its demand for their disqualification under the Tenth Schedule of the Constitution were ignored.
“The Chairman has taken cognisance of the letter submitted by those seven MPs and based on that, accepted their merger. The objection raised by us and the disqualification we sought under the Tenth Schedule of the Constitution have not even been considered,” Singh said, expressing disappointment at the procedure.
Singh added that AAP remains hopeful the Chairman will examine the party’s letter and act in favour of the Constitution and democracy by disqualifying the seven members. “If that does not happen, we will approach the court. It is wrong to break a party in this manner,” he said.
Singh had written to the Rajya Sabha Chairman on Sunday seeking the disqualification of the seven members, arguing their move violated the anti-defection provisions of the Constitution.
The development follows a major setback for AAP on Friday, when seven of its 10 Rajya Sabha MPs — Raghav Chadha, Ashok Mittal, Sandeep Pathak, Harbhajan Singh, Rajendra Gupta, Vikramjit Sahney and Swati Maliwal — quit the party and joined the BJP, alleging AAP had strayed from its founding principles and core values.
