Senior Congress leader Pawan Khera has moved the Telangana High Court seeking anticipatory bail in a criminal case filed by Rinki Bhuyan Sarma, wife of Assam Chief Minister Himanta Biswa Sarma. The complaint follows Khera’s allegations that Rinki Bhuyan Sarma holds multiple passports and owns foreign property that were not declared in the chief minister’s election affidavit. Khera told the court he resides in Hyderabad and asked that he be released on bail if arrested; Justice K. Sujana of the Telangana High Court is scheduled to hear the petition on Thursday.
The FIR was registered at the Guwahati Crime Branch Police Station and lists multiple offences, including Section 175 (false statement in connection with an election), Sections 35 and 36, Section 318 (cheating), Sections 338 and 337 (forgery-related offences), Section 340 (forgery of document or electronic record and using it as genuine), Section 352 (intentional insult to provoke breach of peace) and Section 356 (defamation). Anticipatory bail is a court order that protects an accused from arrest pending trial; Khera’s petition seeks that protection ahead of any detainment.
A team from the Assam Police visited Khera’s Delhi residence on Tuesday to question him and carry out a search, but he was not at home. Authorities said they recovered some “incriminating material” during the search but declined to disclose details at this stage. A police official speaking outside the premises said, “A case has been registered. We wanted to talk to Pawan Khera but couldn’t meet him as he is not here. We found some things in his house, but I will not disclose the details. We don’t know where he is right now, but we will trace him out.”
The case centers on alleged nondisclosure in an election affidavit and related charges of cheating, forgery and defamation, which the complainant says warrant a criminal probe. With the Telangana High Court set to consider Khera’s anticipatory bail application on Thursday, the immediate legal question is whether the court will grant him protection from arrest while the investigation continues.
