Following the court’s ruling he initially ordered an additional 10 percent tariff on all imports, then said on Saturday that he had the authority under law to raise that levy to 15 percent and would impose the maximum level for 150 days while his administration drafts new rules to align with legal requirements. On his social platform Truth Social he wrote, “For decades many countries have been ripping off America. I have increased tariffs on imports worldwide from 10% to 15%.”
Business groups and a coalition of 12 states — most led by Democrats — brought the challenge, arguing that the president acted unilaterally and outside the constitutional allocation of taxing and tariff powers, which belong to Congress. The administration had relied on the International Emergency Economic Powers Act (IEEPA) to justify broad tariff authority without congressional approval.
Economists and trade experts warn the tariff hike could raise import costs for U.S. businesses and consumers and heighten tensions in international trade. Analysts say the measure may particularly affect trade relations and negotiations with Europe, China and many developing countries. Whether the 150-day temporary tariff will survive further litigation or Congressional scrutiny remains uncertain; legal complexities surrounding the policy are likely to produce new challenges in the coming weeks.
