
After 13 Years of Legal Battles, Couple Reflects on 65 Days Together
NEW DELHI: A couple who shared just 65 days of marriage has waged a legal battle spanning over 13 years, resulting in over 40 cases filed against each other across various courts. In a notable ruling on Tuesday, the Supreme Court fined both individuals ₹10,000 each for using judicial forums as a battleground and overwhelming the legal system.
Justices Rajesh Bindal and Manmohan granted the couple a divorce under Article 142, emphasizing that neither party should misuse the judicial process or file further cases against one another. The bench commented, “Considering the brief period they lived together and the extensive litigation aimed seemingly at settling scores, both parties deserve to be penalized with costs.”
The court highlighted that this couple had filed more than 40 cases against each other, declaring, “Warring couples cannot resolve their conflicts by treating courts as battlefields, which clogs the system. Alternative dispute resolution methods, such as mediation, should be considered before litigation begins. Once litigation starts, especially on criminal matters, the potential for reconciliation diminishes, though it should not be completely disregarded.”
The judges expressed concern over the rising number of matrimonial disputes, urging family members to intervene before matters escalate to court. “The court is inundated with transfer petitions, often initiated by wives, either as initial filings or as a counter-response. It is the responsibility of families to help resolve disputes prior to the initiation of civil or criminal proceedings,” the bench stated.
The ruling underscores that society benefits when marriages are maintained. However, if reconciliation fails and the marriage is deemed unsalvageable, acknowledging that reality and proceeding with a divorce is essential to prevent ongoing litigation and suffering among all parties involved.
In this particular case, the marriage took place in January 2012, but the wife left the marital home after just 65 days, alleging cruelty from her husband and his family. They have been living apart ever since, engaging in multiple legal battles in both family courts and high courts in Delhi and Uttar Pradesh.
