Kamrup District Upholds High Court Ruling: ‘Bulbuli Fights’ Banned During Magh Bihu
The Kamrup district administration has implemented a complete ban on Bulbuli bird fights during the Magh Bihu celebrations, citing violations of wildlife protection laws and a recent ruling from the Gauhati High Court. The order was issued under Section 163 of the Bharatiya Nagarik Suraksha Samhita (BNSS), 2023, by District Magistrate Deba Kumar Mishra. He referenced the High Court’s final verdict in WP(C) 466/2024, delivered on December 17, 2024, which deemed the Assam government’s December 27, 2023 notification allowing buffalo and Bulbuli fights illegal and contrary to the Wildlife Protection Act, 1972, along with other animal protection laws.
The order indicated that there were intelligence reports indicating a potential for violations during the upcoming Magh Bihu festivities in certain areas of Kamrup district. The Bulbuli bird is recognized as a protected species under Schedule IV of the Wildlife Protection Act, and organizing fights involving this bird would constitute cruelty and endanger a protected species.
Addressing the traditional Bulbuli fights held in Hajo, the magistrate stressed that continuing such events would breach both legal provisions and clear court directives. The High Court’s ruling unequivocally opposed the legality of these fights.
Invoking powers under Section 163 BNSS, the district administration has thus prohibited any Bulbuli fights within Kamrup’s territorial limits, including those customarily held in Hajo, during the Magh Bihu celebrations. This order is effective immediately and will last until further notification is issued.
The administration stated that the order was enacted ex parte, as conditions did not allow for prior notification to individuals or organizations involved. Those affected by this decision may contact the district magistrate to request changes or rescission of the order.
The Superintendent of Police for Kamrup has been assigned to enforce this ban strictly. Any violations of this order will lead to penal consequences under Section 223 of the Bharatiya Nyaya Sanhita and other relevant legal provisions.
