Kerala High Court Grants Dulquer Salmaan the Green Light: A Triumph in the Fight for His Luxury Car’s Release!
On Tuesday, the Kerala High Court directed actor Dulquer Salmaan to pursue the provisional release of his Land Rover Defender by submitting an application to the adjudicating authority under the Customs Act, 1962. The vehicle was seized by Customs officials during ‘Operation Numkhor’, an initiative aimed at combating tax evasion and the illegal import of vehicles from Bhutan with forged registrations.
In its interim order, the Court mandated that the Customs Department must make a decision within one week of receiving Dulquer’s application. The ruling emphasized that it is standard practice for the petitioner to seek this route, stating, “It is proper for the petitioner to approach the adjudicating authority, the Additional Commissioner of Customs, Kochi. If the petitioner submits an application under Section 110A, it shall be considered by the competent authority, which must ensure a hearing for the petitioner or their legal representative within a week from the application date.”
The Court further elaborated that provisional release is typically a right granted to the petitioner under normal circumstances. Should the Customs Department deny the application, it must issue a detailed order that references the documents submitted and the arguments presented.
Dulquer Salmaan’s SUV was among over 35 luxury vehicles confiscated during recent raids across Kerala, including locations associated with actors Dulquer Salmaan and Prithviraj Sukumaran. These operations are part of a broader crackdown on individuals suspected of illicit activities related to vehicle imports. Salmaan’s Land Rover Defender, a 2004 model, was specifically highlighted in the seizures.
On September 25, the actor lodged an appeal with the Customs Authority, submitting comprehensive documentation to support his claim for the vehicle’s release. However, his initial request was denied, prompting him to seek intervention from the High Court.
