HITO Seeks Urgent Legal Clarity on Controversial MBBS Quota System
The Hynñiewtrep Integrated Territorial Organisation (HITO) has called upon Meghalaya’s Chief Secretary Shakil Ahamed to clarify the legal and policy foundations behind the state’s MBBS quota allocation system. In a letter addressed to Ahamed, HITO expressed concerns about the lack of a formal reservation policy for higher and professional education in Meghalaya, a deficiency it contends has persisted since the state’s establishment.
HITO criticized the government’s reliance on “conventional practice” for implementing the MBBS quota, a method it claims has led to confusion and uncertainty among students. The organization highlighted that the absence of clear regulations adversely affects deserving candidates, leaving both students and educational institutions unclear about the legal standing of the current reservation system for medical admissions.
The letter referenced ongoing legal proceedings, including WP(C) No. 122 of 2023 and Cont. Case (C) No. 19 of 2023, which referred to a government communication dated September 13, 2023. This communication asserted that the “principle and spirit” of the state’s Reservation Policy were being applied to admissions in state-run educational institutions based on established practices. However, HITO countered that this reliance on unwritten standards exacerbates the existing policy vacuum.
As the MBBS admissions process progresses, HITO is urging immediate responses to three key inquiries: the legal framework supporting the MBBS quota system, any official government notifications or cabinet decisions that endorse it, and the government’s plans to formalize a reservation policy to reduce future ambiguities. HITO cautioned that ongoing uncertainties could severely affect students awaiting their seat allocations.
The organization emphasized the importance of swift and transparent clarifications to protect students’ rights and academic prospects. The letter was signed by HITO President Donbok Dkhar and Legal Secretary Shaniah Nongrum, who urged the government to address what they described as a persistent policy gap through appropriate legal and administrative measures.
