Justice Served: Karnataka HC Cracks Down on Two Medical Colleges for Ignoring KEA in PG Admission Scandal!

The Karnataka High Court has taken a firm stance against two medical colleges, instructing the National Medical Commission (NMC) to take action following the illegal admission of four students into post-graduate programs for the academic year 2023-24. This directive comes after the students, Tisa Robinson, Ashish Appasabeb Patil, Hemanth Kumar P., and Nishanth G.V., were admitted directly, bypassing the crucial counseling process mandated by the Karnataka Examinations Authority (KEA).

During proceedings, a division bench comprising Justices D.K. Singh and Venkatesh Naik T. expressed their shock at the NMC’s advocate’s claim that these admissions would be regularized because the colleges had no choice but to admit the students after KEA failed to fill the available seats through counseling. The bench found this argument troubling and inconsistent with the Post Graduate Medical Education Regulation (PGMER) 2023.

The court subsequently directed the chairperson of the NMC to submit an affidavit regarding the legitimacy of these direct admissions. In a follow-up filing, the NMC confirmed that the admissions at both Kanachur Institute of Medical Sciences and K.V.G. Medical College and Hospital were indeed illegal, violating regulation No. 4.3 of the PGMER-2023, which requires all admissions to undergo a mandatory counseling process.

The judges criticized the NMC’s legal counsel for presenting arguments that conflicted with established regulations, stating, “We do not know whether the counsel for the statutory body can make submissions against the statutory prescription.” The bench underscored that it was incumbent upon the NMC to address the issues raised and handle the situation appropriately, emphasizing their disapproval of the manner in which the case was presented.

Furthermore, the court noted discrepancies in the information provided by Kanachur College, specifically concerning a false affidavit related to the surrender of two seats to the Directorate of Medical Education. This revelation underscores the serious implications of non-compliance with educational regulations.

As the legal proceedings continue, the Karnataka High Court’s decision serves as a reminder of the importance of adhering to established admission processes in the education sector. The court’s ruling reflects a commitment to upholding regulatory standards and ensuring that admissions in medical education are conducted fairly and transparently.

The implications of this ruling extend beyond the immediate admissions of these four students, signaling a robust response from the judiciary to uphold the integrity of educational processes in Karnataka. With the NMC now compelled to take action, the case highlights the ongoing challenges related to admissions in professional courses and the necessity for regulatory frameworks to be respected.
