Delhi High Court Advocates for Nuanced Legal Approach to Adolescent Relationships
Guwahati: In a significant observation, the Delhi High Court has emphasized the need for statutory rape laws to accommodate the nuances of consensual adolescent relationships. Justice Jasmeet Singh noted that adolescents deserve the freedom to form romantic relationships without facing criminalization, provided these connections are consensual and devoid of coercion.
Addressing the necessity for legal evolution, the court asserted that love is a fundamental aspect of human experience, and thus, adolescent relationships should be respected. The bench proposed a compassionate legal approach that prioritizes understanding over punishment in cases of youthful romance.
Currently, the Protection of Children from Sexual Offences (POCSO) Act of 2012 criminalizes even consensual relationships if one participant is under 18. This observation arose during a case involving a Class 12 girl, reported missing in December 2014, later discovered with a young man. Despite being over 18, he faced charges under the POCSO Act. His subsequent acquittal by a trial court led to the State’s appeal.
On January 30, the Delhi High Court dismissed the appeal, acknowledging the girl’s testimony that the relationship was consensual and highlighting inconsistencies in her age determination, estimated between 16 and 17 at the time.
The court concluded that convicting the accused without definitive age evidence would be "harsh and unjust." However, it clarified that ignoring POCSO provisions would be a miscarriage of justice in cases where victims are assuredly under 14 or 15 years old. This ruling signals a potential re-evaluation of the strict application of statutory rape laws to reflect the complexities of adolescent relationships.
