Delhi HC’s Empowering Decision: Expunged Remarks Shield Crime Branch from Devastating Impact of Strong Criticism
The Delhi High Court recently sided with the Delhi Police by directing the removal of critical comments made by a trial court against the Crime Branch and its officers in three separate cases. Justice Amit Mahajan issued an order on February 7, acknowledging the “anguish” expressed by the trial court but cautioning that harsh criticisms could severely impact the reputation and careers of involved officials.
The Crime Branch had filed petitions in 2022 and 2023, challenging the remarks made by the Chief Metropolitan Magistrate of Karkardooma Court in nine orders related to three First Information Reports (FIRs) from 2007 and 2020. These cases involved charges of forgery, improper use of emblems and names, and violations under the Arms Act. The trial court had expressed frustration over the Crime Branch’s failure to comply with its directives during investigations.
Justice Mahajan recognized that the trial court’s concerns were justified due to perceived shortcomings in the investigative process. However, he emphasized that disparaging remarks that could undermine the credibility of the investigating authority should be avoided. He suggested that if the trial court was dissatisfied with how investigations were conducted, it could have simply recorded the facts without using harsh language.
The High Court noted that while court orders must be respected and followed, scathing remarks could have lasting negative consequences. It stressed the importance of maintaining the dignity and authority of the judiciary while ensuring that every word in judicial orders carries significance.
The decision highlights the balancing act between holding law enforcement agencies accountable and safeguarding their reputation from potentially career-damaging criticism.
