Empowering New Beginnings: Government Safeguards Secure, Orderly Immigration for Indians Amid U.S. Deportations
The Indian government is responding to the deportation of illegal Indian immigrants by the US Trump 2.0 administration by drafting a new law aimed at ensuring safe and organized migration for Indians seeking employment overseas. The proposed Overseas Mobility (Facilitation and Welfare) Bill, 2024, intends to update the outdated Emigration Act of 1983, thereby facilitating smoother and safer migration processes. The law will establish a framework for legal and orderly migration, with the draft currently under inter-ministerial review and slated for public feedback soon.
Ministerial discussions and public consultations will precede the bill’s final approval. The Ministry of External Affairs (MEA) emphasizes that the new legislation will work towards migrants’ welfare, with the Protector of Emigrants collaborating with Indian embassies and consulates to address grievances and overseas employment challenges.
Recently, 104 Indian nationals were deported from the US due to illegal immigration, highlighting the urgent need for this legislative overhaul. Among the deportees were 33 individuals from Haryana and Gujarat, 30 from Punjab, and others from different states, including 19 women and minors as young as four years old.
In response to these events, External Affairs Minister S. Jaishankar assured Parliament of the government’s preparedness to protect Indian citizens abroad under crisis situations, citing their effective response during the Ukraine crisis as an example. According to the 2022 Pew Research Center report, India ranks third in the number of unauthorized immigrants in the US, with 725,000 individuals. The increasing number of Indians attempting entry into the US via the Canadian border has also been noted, with arrests exceeding 14,000 in the past year, marking a significant rise compared to previous years.
By implementing the new legislation, India hopes to mitigate these challenges and ensure a more streamlined and secure migration process for its citizens.
