High Court Demands Urgent Government Response to Controversial Muslim Marriage & Divorce Act Petition | Guwahati News
The Gauhati High Court has ordered the Assam state government to respond by February 17 to a petition challenging the Assam Compulsory Registration of Muslim Marriage and Divorce Act, 2024. This petition, filed by the Muslim Students’ Union of Assam Central Committee, seeks to annul both the 2024 Act and the related Assam Repealing Act, citing concerns for community justice and constitutional rights. The Muslim Students’ Union asserts that these new laws replaced the longstanding Assam Muslim Marriage and Divorce Registration Act and Rules from 1935 without proper justification or public discourse. The petition was presented before a bench comprising Chief Justice Vijay Bishnoi and Justice Kaushik Goswami.
Ashik Rabbani, head of the petitioner organization, argues that the legislation was passed arbitrarily and without discussion, leading to potential harm and increased vulnerability for the Muslim community. Attempts to engage governmental authorities via a memorandum in November last year reportedly yielded no significant response.
Petitioners are pushing for the restoration of the status quo that existed prior to the 2024 legislation. They demand the reimplementation of the previous registration processes for Muslim marriages and divorces in Assam, which involved government-appointed registrars and kazis. AR Bhuyan, the legal counsel for the petitioners, has labeled the new acts unconstitutional and is seeking their invalidation to ensure rights are upheld according to constitutional and Islamic Personal Laws.
