Urgent Directive: Gauhati HC Compels Assam, Nagaland, Mizoram, and Arunachal to Transform Dire Jail Conditions
The Gauhati High Court has directed the states of Assam, Nagaland, Mizoram, and Arunachal Pradesh to submit detailed affidavits addressing issues highlighted in a recent report on the conditions of central and district jails within their jurisdictions. Chief Justice Vijay Bishnoi and Justice Kaushik Goswami underscored the necessity for these states to document the actions they have taken in response to recommendations provided by an inspection committee.
The court has mandated that the states clarify whether the suggested measures have been implemented and, if not, provide a timeline for their execution. This directive follows an affidavit from the High Court’s Registrar General, submitted on August 20, which included an inspection report compiled by officials from the Assam State Legal Services Authority and the prison departments of Guwahati and Jorhat. The report revealed unsatisfactory conditions in the jails across the four northeastern states and proposed various improvements.
Despite the pressing concerns outlined in the report, the court noted that none of the states had responded to the affidavit. Consequently, the division bench has ordered them to file their affidavits ahead of the next court hearing scheduled for January 29, 2025. The court emphasized the urgency, stating, “By that time, the affidavits on behalf of all the four States be filed positively.”
The states are now expected to submit detailed responses and updates on the actions they are undertaking to address the highlighted issues. This directive seeks to prompt timely and effective remedial measures to improve the state of the correctional facilities, ensuring they meet appropriate standards and address the concerns detailed within the inspection report.
