Heartfelt Battle: Atul Subhash’s Mother Fights in Supreme Court for Beloved Grandson’s Custody
In a developing legal battle, Anju Modi, the mother of Bengaluru engineer Atul Subhash who died by suicide on December 9, has moved the Supreme Court to gain custody of her four-year-old grandson. Modi’s habeas corpus petition claims her son’s estranged wife, Nikita Singhania, and her family—currently in custody—have not disclosed the child’s whereabouts after being implicated in Subhash’s death.
Subhash left behind video and written notes alleging harassment and false accusations from his wife and in-laws, leading to multiple arrests including Nikita, her mother Nisha, and brother Anurag on charges of abetment to suicide. The Karnataka Police acted on evidence from Subhash’s notes and video.
Nikita claimed the child was in a Faridabad boarding school under the care of her uncle, Sushil Singhania. However, Sushil refuted having any knowledge of the child’s location. The Supreme Court, involving Justices BV Nagarathna and N Kotiswar Singh, issued notices to Uttar Pradesh, Haryana, and Karnataka governments, seeking clarity before a January 7 hearing.
Meanwhile, the Singhania family is legally contesting their predicament. Sushil Singhania secured pre-arrest bail from the Allahabad High Court, citing his age and health, and alleging exaggerated accusations. Subhash’s family, led by his father Pawan Kumar, claims that Nikita’s family relentlessly harassed Subhash with false legal cases and monetary demands, ultimately leading to his tragic end.
Subhash’s family has vowed not to perform his last rites until the false cases against them are withdrawn and they gain custody of the child. “We will not immerse the ashes of my brother till we get justice,” declared his brother, Bikas Kumar. With mounting concerns for the grandson’s safety, the family urges immediate action and custody transfer, expressing their anxiousness over the child’s current situation.
