A legal battle involving Elon Musk, the CEO of Tesla and supporter of Republican presidential nominee Donald Trump, has taken a turn as his case over a $1 million daily voter giveaway returns to state court. The lawsuit, filed by Philadelphia District Attorney Larry Krasner, accuses Musk and his political action committee, America PAC, of operating an illegal lottery to influence voters in Pennsylvania’s presidential election between Trump and Kamala Harris.
Krasner has requested an injunction to halt the giveaways, which target registered voters in swing states, including Pennsylvania. After Musk attempted to move the case to federal court, U.S. District Judge Gerald Pappert ruled that it should remain in state court, emphasizing that the legal issues are grounded in state, not federal law. The ruling came after Judge Angelo Foglietta initially paused proceedings due to the case’s temporary removal to federal court.
Musk’s attorney, Matthew Haverstick, has contested the order for Musk to attend court, calling it harassment and an attempt to hinder Musk’s free speech rights amid the election. Krasner asserts that America PAC’s last-minute legal maneuvers were improper. As the case returns to the Philadelphia Court of Common Pleas, further hearings are expected to address the legality of Musk’s voter engagement tactics.
