Gauhati High Court Questions CBI Inaction in Nagaland High Court Complex Case
Dimapur | October 5: The Gauhati High Court Kohima Bench (GHCKB) recently expressed surprise over the Central Bureau of Investigation’s (CBI) lack of action against a Nagaland Government order, which denied prosecution sanction against state employees implicated in irregularities surrounding the construction of the new High Court Complex in Kohima.
Justice Kakheto Sema has directed the CBI counsel to provide a detailed affidavit explaining the agency’s inactivity. Parallelly, Nagaland’s Public Prosecutor has been tasked with presenting relevant records regarding the state’s order to withhold prosecution sanction. The court will consider interim relief on the next scheduled date and has set the matter for further hearing in three weeks.
This directive emerged during a petition hearing that seeks to quash a First Information Report (FIR) from June 17, 2019; a CBI report dated July 21, 2021; and an order from the Special Judge, CBI, Dimapur, pushing the petitioners towards a criminal trial under IPC Sections 420 and 120B.
During a September 10 hearing, the petitioners’ counsel, representing contractors of the court complex, argued their non-involvement in the alleged anomalies and questioned why charges were not extended to state employees if culpability is established. Although court orders do not provide detailed case insights, an August 12 press release from the Directorate of Enforcement (ED) revealed asset attachments valued at Rs. 96 lakh under the Prevention of Money Laundering Act (PMLA) following an investigation into financial misconduct linked to the complex’s construction.
Initiated by a CBI FIR, the investigation alleged Rs. 3.61 crore in public fund misappropriation. The CBI has filed multiple chargesheets, highlighting implicated parties, including Nagaland Public Works Department engineers and contractors accused of financial irregularities totaling approximately Rs. 109.93 lakh. The present petitions in GHCKB have been filed by contractors Thepfusatuo Rio, Mhalelio Rio, and Vibeilietuo Kets, who seek relief amidst these allegations.
