The victim, a 41-year-old woman named Yan, had undergone several rounds of IVF treatments over three years to become pregnant.
The incident occurred as Yan was walking through her residential complex to collect a package. Suddenly, a golden retriever dashed out of a building, startling Yan and causing her to step back and injure her back. She immediately felt discomfort in her waist and lower abdomen.
Later that day, Yan was admitted to the hospital and kept under observation overnight. By the next morning, doctors announced that no fetal heartbeat could be detected. The loss was particularly heartbreaking given Yan’s immense effort and emotional toll to conceive.
Yan subsequently filed a lawsuit against the dog’s owner, Li, who acknowledged that his dog was unleashed but defended himself by stating the dog was an assistance animal and posed no threat. Li further argued that Yan, given her high-risk pregnancy due to IVF, should have been more cautious.
However, the court ruled in Yan’s favor, citing the Animal Epidemic Prevention Law, which mandates that dogs be leashed in public spaces. The court concluded that Yan’s miscarriage was directly caused by being startled by Li’s unleashed dog, holding Li accountable for the tragic outcome.
