This superseding indictment was presented to a new grand jury unfamiliar with the case’s earlier evidence.
The DOJ does not oppose allowing Trump to waive his arraignment appearance on the new indictment. A source close to Trump’s defense argues the indictment’s flaws remain, maintaining that official acts during a presidency cannot be prosecuted. The case, focusing largely on events surrounding the January 6 Capitol riot, is viewed as one of the most severe among those Trump faces while seeking another term.
Smith’s case was stalled as Trump’s legal team argued for his immunity, which the Supreme Court eventually granted for certain official acts, but not for all. The ruling significantly impacted Smith’s case, removing any charges linked to Trump’s discussions with the DOJ. District Court Judge Tanya Chutkan was instructed to evaluate allegations concerning Trump’s pressure on then-Vice President Mike Pence over the 2020 electoral results. Smith’s new indictment reflects efforts to respect the Supreme Court’s directives.
