Enthusiasts in U.S. Army WWII-era uniforms paraded along Utah Beach on June 6, 2024, in tribute to the 80th anniversary of D-Day commemorations in Normandy. Amid these celebrations, troubling data has emerged: nearly 122,000 disabled veterans were forced to repay separation payouts totaling tens of thousands over the last 12 years, due to a federal law requiring them to return this money if they receive disability benefits.
The law, which prevents veterans from receiving both disability and special separation pay, has put many in financial hardship. For instance, Vernon Reffitt was told to repay $30,000 he received 30 years ago. The U.S. Department of Veterans Affairs (VA) noted the peak in veteran recoupments in fiscal year 2018, with 17,000 cases, and a resurgence in 2023, rising to nearly 9,300 cases.
This increase follows the 2022 PACT Act, extending benefits to veterans exposed to toxic substances. Some veterans experienced recoupment issues only after filing PACT Act claims. Shawn Teller, for example, was informed he must repay the $10,700 he received upon separating from the Army in 1996.
VA spokesperson Terrence Hayes stated that recoupments are legally required when veterans apply for disability payments, and there is no "concerted effort" to increase these recoupments. However, growing calls advocate revising this law, which veterans’ groups argue unfairly links separation and disability benefits.
Efforts for law changes include a 2022 bill proposed by Rep. Ruben Gallego, though progress is slow due to financial implications. Some exceptions exist under equity and conscience standards, but they remain rare.
Advocates stress the two compensations are distinct, with special separation pay accounting for service duration, while disability pay compensates for service-related injuries. The ongoing financial strain highlights the need for reform to ensure veterans receive the benefits they’ve earned.
