Biden’s Student Loan Relief Plans Face Legal Hurdles, but Some Relief Stands
The Biden administration’s student loan forgiveness initiatives have encountered significant legal obstacles. The Supreme Court nullified President Joe Biden’s initial broad debt relief plan last summer. Currently, the new income-driven repayment program, termed the Saving on a Valuable Education (SAVE) plan, is partly suspended due to lawsuits from Republican-led states, including Arkansas, Florida, and Missouri. Experts predict Biden’s renewed efforts at large-scale debt forgiveness will face similar resistance.
Despite the legal tangles, student borrowers can still access some relief. Rolled out in summer 2023, the SAVE plan is touted as the most affordable student loan repayment option to date. It reduces monthly payments to 5% of discretionary income and clears debt faster for those with small balances—some as quickly as ten years. Approximately 8 million borrowers have already enrolled in SAVE.
In June, federal judges in Kansas and Missouri temporarily blocked significant parts of the SAVE plan, citing overreach by the Education Department. Although one injunction has been successfully appealed, portions of the plan remain on hold. Borrowers enrolled in SAVE benefit from reduced payments and protection against accumulating interest if they adhere to monthly payments.
The controversy over SAVE has created financial planning difficulties for borrowers, exacerbated by the ongoing legal battles. Aissa Canchola-Bañez from the Student Borrower Protection Center emphasized the uncertainty borrowers face and the need for definitive debt relief measures.
The administration is also finalizing a revised, more targeted loan forgiveness plan, aiming to aid borrowers with growing balances and long-standing debt. However, this plan is expected to meet swift legal challenges, especially following a recent Supreme Court ruling that limits federal regulatory power.
Despite these setbacks, SAVE remains largely intact, allowing enrolled borrowers to benefit, and other income-driven repayment plans and the Public Service Loan Forgiveness program remain unaffected. Consumers are advised to explore available relief options.
