Karnataka High Court Dismisses CM Siddaramaiah’s Challenge to Governor’s Prosecution Sanction in MUDA Land Scam
Bengaluru – The Karnataka High Court has rejected Chief Minister Siddaramaiah’s petition challenging Governor Thawar Chand Gehlot’s sanction for his prosecution in the alleged MUDA land scam. Justice M Nagaprasanna stated the Governor’s decision was well-considered and "does not suffer from non-application of mind." Consequently, the court dismissed both Siddaramaiah’s petition and a subsequent plea to stay its order, emphasizing the correctness of the Governor’s actions and the necessity for further investigation.
This ruling allows the lower court to proceed with legal actions against the Chief Minister, potentially escalating political pressure. Security was heightened around Siddaramaiah’s residence in anticipation of the verdict, underscoring the tension surrounding the case.
Following the verdict, the BJP renewed calls for Siddaramaiah’s resignation, with state unit chief BY Vijayendra urging him to step down immediately, accusing the Congress of corruption. Conversely, Congress leaders, including Deputy CM DK Shivakumar, labeled the decision a "big conspiracy," affirming their commitment to fight legally and maintain Siddaramaiah’s position.
Siddaramaiah had argued that the Governor’s sanction was illegal, claiming it bypassed required state approval and violated natural justice principles. However, the court upheld the Governor’s decision as an independent action not necessarily reliant on ministerial advice.
The MUDA land scam involves allegations that land allotted to Siddaramaiah’s wife in Mysuru was significantly overvalued, causing a substantial financial loss. The Governor’s clearance came on August 17, sparking widespread protests by Congress.
Siddaramaiah, asserting his innocence and a spotless political career, expressed confidence in receiving judicial support. The case continues to generate significant political and public interest as legal proceedings move forward.
