
Historic Supreme Court Ruling on Muslim Women’s Maintenance Rights Triumphantly Welcomed by NCW
The National Commission for Women (NCW) Chairperson Rekha Sharma has lauded the Supreme Court’s recent ruling that permits divorced Muslim women to claim maintenance under Section 125 of the Criminal Procedure Code (CrPC).
On June 10, the Supreme Court deemed denying Muslim women alimony under secular laws regressive and against the principles of gender justice and equality. Sharma underscored that women’s rights should be uniform across all religions, applauding the court’s decision as a progressive stride towards gender equality.
The NCW chief stressed the necessity of harmonizing personal laws related to women across various faiths. She pointed out the existing disparities between Hindu and Muslim divorce laws concerning alimony, advocating for equitable treatment.
Sharma also addressed a recent incident involving offensive remarks made about the widow of Kirti Chakra recipient Captain Anshuman Singh. The NCW took suo motu cognizance, prompting a police FIR. Sharma indicated that the suspect is likely from Pakistan and assured that similar cases are being treated with urgency.
Following the NCW’s letter, Delhi Police have registered a case under relevant sections of the IT Act and are conducting an investigation.
Captain Anshuman Singh, posthumously awarded the Kirti Chakra, tragically lost his life while saving individuals during a fire at an Army ammunition dump in Siachen Glacier. His wife and mother received the prestigious award from President Droupadi Murmu.
