Delhi Motor Accident Tribunal Awards 36 Lakh to Victim’s Family

A Motor Accident Claims Tribunal (MACT) in Delhi awarded a compensation of Rs. 36 lakh to the family of a 20-year-old woman who lost her life in a hit-and-run incident on New Year’s Day in 2023. The victim, Anjali, was struck by a car and dragged for approximately 10-12 kilometers from Sultanpuri to Kanjhawala, where her body was subsequently abandoned by the occupants of the vehicle. In April 2023, more than three months after the incident, the Delhi Police submitted an 800-page chargesheet listing 117 witnesses. The Rohini Court subsequently acknowledged this chargesheet on April 13.

In July 2023, a Delhi court charged seven individuals with several offenses, including murder, criminal conspiracy, destruction of evidence, harboring offenders, and providing false information to public officials. As of now, six of the seven accused remain out on bail while the case is ongoing.

District Judge Vikram, presiding over the Tribunal in Rohini, noted in an order dated October 27 that the driver’s rashness and negligence were evident and directly responsible for the accident and its aftermath. He stated, “The driver was responsible for the death of the deceased due to his neglect and default in driving the vehicle at the relevant time. Therefore, the petitioners are entitled to compensation for the death of the victim.”

In determining the compensation amount for Anjali’s dependents-her mother, two minor sisters, and a minor brother-the Tribunal considered factors such as her age, her income at the time of her passing, and the number of dependents. Classifying Anjali as an unskilled worker, the Tribunal recognized the minimum wage for such a position in Delhi as Rs. 16,792 per month. After accounting for monthly expenses, the Tribunal calculated the monthly loss of dependency, which was then multiplied by 12 to reflect annual values.

The annual loss was further adjusted using an appropriate multiplier. An additional 40% was added to account for Anjali’s young age and future prospects, totaling the loss of dependency at Rs. 33.85 lakh. Furthermore, the Tribunal allocated Rs. 1.93 lakh for “loss of consortium,” signifying loss of love and affection, along with Rs. 90,000 designated for funeral expenses.

The individuals facing trial in connection with this case are Manoj Mittal, Amit Khanna (the driver), Krishan alias Kalu, Mithun alias Arjun, Deepak Khanna, Ankush Khanna, and Ashutosh Bhardwaj. Anjali is survived by her mother and five siblings; she lost her father nearly eight years prior to her tragic death.
