A Delhi court has acquitted a man accused of forgery more than 12 years after charges were filed against him, citing inconsistencies between handwriting samples and the signature on a cheque linked to the alleged fraud. Judicial Magistrate First Class Aridaman Singh Cheema stated in a September 17 ruling that the handwriting of the accused did not align with the disputed signature on the cheque, based on a report from the Forensic Science Laboratory.
The court noted that the complainant failed to provide a satisfactory explanation for the delay between the alleged offence, which occurred on September 10, 2012, and the filing of the First Information Report (FIR) on March 6, 2013.
The accused, Ram Dutt, faced allegations of cheating Virender Pal Singh by presenting what was claimed to be a forged cheque at a bank in Sarita Vihar in September 2012. The cheque, originally issued for Rs. 6,326 by First Select Pvt. Ltd., was purportedly altered to Rs. 60,326.
Dutt was charged with using a forged document as genuine, forgery of valuable security, and dishonestly inducing property transfer. He allegedly misled the complainant bank into transferring Rs. 60,326 into his account.
The court emphasized that no examination of the cheque’s signatories had taken place, which included two individuals whose signatures appeared on the cheque dated September 6, 2012. Additionally, it pointed out that the relevant officers from the firm that issued the cheque were never called to testify, nor did the handwriting evidence align with Dutt’s sample as per the forensic report.
