Frustration Mounts Over 8.82 Lakh Death Penalty Appeals Pending!
The Supreme Court of India has expressed concern over the pending appeals for the death penalty, which now exceed 882,000 across various courts. These appeals primarily arise after civil judgments that are submitted for execution. The information was revealed during the review of an implementation order from March 6 by Justices J.B. Pardiwala and Pankaj Mithal. The order mandated all high courts to resolve these appeals within six months; failure to do so would result in accountability for the respective judges.
Despite the court noting that 338,000 death penalty appeals have been resolved since the March order, the troubling number of 882,000 appeals still remain unresolved. The court labeled this situation as an “insult to justice,” emphasizing that if it takes years to act on orders, the process loses its purpose. High courts have been directed to guide district courts to expedite and effectively resolve these matters. Additionally, the Karnataka High Court has faced criticism for failing to provide necessary information. The Supreme Court has ordered Karnataka’s Chief Secretary to submit an explanation for this lapse within two weeks.
This issue originated from a land dispute between two individuals in Tamil Nadu that has been ongoing since 1980. The delay in executing orders has been attributed to errors on the part of the Supreme Court. The Supreme Court has now scheduled the next hearing for April 10, 2026, and has requested complete data on all pending and resolved death penalty appeals from all high courts.
