Vice President Jagdeep Dhankhar has submitted his resignation, prompting the need for an election to fill the position to be conducted “as soon as possible” in accordance with constitutional provisions. Article 68(2) of the Constitution mandates that any vacancy in the Vice-President’s office-whether resulting from resignation, removal, death, or otherwise-must be addressed without undue delay. The elected individual will serve a complete five-year term, commencing on the day they assume office, regardless of any remaining duration from the previous term.
The Constitution does not clarify who assumes the Vice-President’s full responsibilities if a resignation occurs before the term concludes. However, in the Vice-President’s capacity as Chairperson of the Rajya Sabha, the duties during such a vacancy are typically handled by the Deputy Chairperson or another member of the Rajya Sabha authorized by the President of India.
As the ex officio Chairperson of the Rajya Sabha, the Vice-President holds no other profit-generating office and is expected to serve a five-year term. Notably, a serving Vice-President can remain in office beyond the completion of their term until a successor is sworn in.
The resignation process involves the Vice-President formally submitting their resignation to the President of India, with the resignation becoming effective only upon acceptance. While this process is clearly articulated in the Constitution, it has not yet been officially confirmed in this instance.
The Vice-President is elected by an Electoral College, which comprises members of both Houses of Parliament. The election employs a proportional representation system based on a single transferable vote. To qualify as a candidate, an individual must be a citizen of India, at least 35 years of age, and eligible for election to the Rajya Sabha. Those holding any office of profit under the central or state government or a local authority are disqualified from candidacy.
