Bombay HC Delays Celebi’s Appeal: Tension Builds as Mumbai Airport Contract Termination Awaits Delhi HC Ruling!

The Bombay High Court has postponed the hearing of a petition filed by Celebi NAS Airport Services India Pvt Ltd until July 10, 2025. This Turkish-Indian joint venture, which specializes in ground handling services at various Indian airports, is contesting the termination of its operations by Mumbai International Airport Limited (MIAL). Celebi has been embroiled in multiple legal disputes across Mumbai, Delhi, Gujarat, and Chennai, and this latest setback adds to its challenges.

During the court session, a Division Bench consisting of Justices B. P. Colabawalla and Firdosh Pooniwalla learned that MIAL had canceled the services of Celebi and its subsidiaries at seven airports nationwide. Solicitor General Tushar Mehta, representing the Union government, informed the court that similar petitions had been filed by Celebi in the Delhi High Court and the Madras High Court. “The Delhi High Court has reserved its order after extensive arguments, while the Madras High Court will await the Delhi ruling, given the shared issues in these petitions,” Mehta explained. He urged the Bench to consider deferring proceedings until the Delhi High Court delivers its judgment.

Celebi’s counsel, senior advocate Chetan Kapadia, concurred with the Solicitor General’s request. The Bench, acknowledging the significance of the Delhi High Court’s upcoming decision, chose to adjourn the hearing.

This judicial development follows an earlier order on May 26, 2025, in which the Bombay High Court prohibited MIAL from awarding bids intended to appoint a new agency to replace Celebi’s subsidiary for ground and bridge handling services at Chhatrapati Shivaji Maharaj International Airport. The court’s ruling is set to remain effective until a regular Bench can review the matter after court vacation.

Celebi’s legal struggle intensified when the Bureau of Civil Aviation Security (BCAS), acting under the Ministry of Civil Aviation, rescinded its security clearance for the firm. This action was taken amid rising diplomatic tensions between India and Turkey, particularly concerning Turkey’s support for Pakistan during Operation Sindoor. Celebi has since filed three petitions challenging the government’s decision to revoke its security clearance and terminate its contract with MIAL, branding the termination as “arbitrary” and “illegal.”

The legal battles faced by Celebi not only spotlight the complexities of airport service contracts but also reflect the broader geopolitical dynamics affecting international businesses in India. As the legal proceedings unfold, industry experts and stakeholders will closely monitor developments that may reshape ground handling operations across the country.

The case continues to draw attention as both legal and diplomatic factors converge, influencing operations for international firms amid a backdrop of national security considerations. The forthcoming decision from the Delhi High Court is anticipated to have significant implications on the fate of Celebi and its operations in India.
