US Supreme Court Rejects Trump’s Push for Venezuelan Deportations
The US Supreme Court issued a significant ruling on Friday, preventing the Trump administration from restarting deportations of individuals believed to be gang members from Venezuela. The court’s decision, reflecting a 7-2 majority, blocks the administration’s use of the 1798 Alien Enemies Act (AEA) to bypass standard legal procedures, marking another setback for President Donald Trump’s attempts to remove alleged members of the Tren de Aragua gang.
This ruling follows the Court’s earlier intervention on April 19, when it halted the expedited deportation of undocumented Venezuelan migrants to a prison in El Salvador. Trump had first invoked the AEA in March to deport a group of purported Tren de Aragua members. In the recent unsigned order, the Supreme Court addressed plans to deport additional detainees from Texas, emphasizing that these individuals were not provided sufficient time to legally contest their removal. The justices stated, “Notice roughly 24 hours before removal, devoid of information about how to exercise due process rights to contest that removal, surely does not pass muster.”
The Court clarified that its focus was not on the legality of using the AEA to deport undocumented migrants. “To be clear, we decide today only that the detainees are entitled to more notice than was given,” they remarked. They confirmed that the merits of the removal claims under the AEA remain unaddressed. The dissenting opinion came from conservative justices Clarence Thomas and Samuel Alito, indicating a division in the court’s approach to immigration enforcement policies.
