Empowering Women in the Armed Forces: Centre Advocates for JAG Entry Case in Supreme Court

Women are increasingly integral to India’s armed forces, contributing to strategic operations and shaping responses to military challenges, including significant actions like the Balakot strike. On Wednesday, the Centre emphasized this evolving dynamic before the Supreme Court. Additional Solicitor General Aishwarya Bhati stated, “Women are playing a very important role… the Balakot strike was engineered by a woman in a control capacity. The face of warfare is changing.”

The remarks came during proceedings regarding a lawsuit filed by two women questioning a January 18, 2023 notification concerning the JAG (Judge Advocate General) Entry Scheme 31st Course. The applicants, who ranked 5th and 6th in the common selection process, expressed concern that they would be excluded from the selection list due to the gender-based allocation of vacancies—six for men and three for women. The Centre explained that the selection criteria between 2012 and 2022 were skewed, with 70% of positions designated for men and 30% for women, though it plans to shift towards a 50:50 ratio from 2023 to 2033.

Justice Manmohan highlighted that this approach still perpetuates gender discrimination, suggesting that gender-specific vacancies undermine the goal of creating a neutral selection process. He questioned the rationale behind limiting women’s deployment, asking, “Why are you making a discrimination that they will not be posted in Area A, B area? Why can’t you deploy them everywhere?”

In response, Bhati reiterated that the existing selection framework is a government policy, noting it will change as the nature of warfare continues to evolve. This acknowledgment of women’s critical roles in the military comes at a time when gender integration in defense forces is increasingly scrutinized and discussed at various governmental levels.

The case represents a broader conversation about gender equality and representation within India’s military institutions, reflecting changing attitudes towards women’s capabilities in high-stakes environments. As India navigates its security landscape, the ongoing integration of women into all aspects of the armed forces may not just transform military dynamics but could also lead to significant cultural changes within the institutions themselves.
