On May 5, India’s Supreme Court issued summons to five social media influencers, including the event organizer of “India’s Got Talent,” Raina, following an application by the Cure SMA Foundation of India. The NGO alleges that these influencers ridiculed individuals suffering from spinal muscular atrophy (SMA) during their event. Justices Surya Kant and N. Kotiswar Singh directed the Mumbai Police Commissioner to ensure the influencers’ appearance in court.
The court highlighted that the actions of these influencers were harmful and demoralizing, asserting the necessity for strict punitive measures to prevent such incidents in the future. The justices emphasized that attempts to integrate disabled individuals into mainstream society should not be undermined by such behavior. Senior Advocate Aprajit Singh, representing the NGO, pointed out that there is legal recourse to assist these individuals, urging the court to take action for a meaningful resolution.
Furthermore, the bench remarked that the rights of freedom of speech and expression are not absolute and should not be used as a pretext to demean others. The NGO brought to attention the existing shortcomings in current legal frameworks, prompting the court to consider formulating guidelines for regulating online content related to disabled individuals and those with rare diseases. Following this, the need for clearer regulations to protect marginalized communities from online ridicule has been accentuated.
This case underscores the pressing issue of online behavior toward vulnerable groups, reinforcing the responsibility that comes with social media influence. The Supreme Court’s proactive stance could pave the way for more robust protections for individuals with disabilities, as society continues to navigate the complexities of digital discourse.
The overarching message from the court serves as a reminder that compassion and respect must guide discourse in all forms, especially when addressing the experiences of those with exceptional challenges. By fostering a more inclusive environment, society can take meaningful steps toward acknowledging and validating the dignity of every individual.
