Breaking: Sikkim Dramatically Tightens Labor Regulations with Bold District Task Forces Initiative!
The Sikkim Labour Department has intensified its enforcement of labour laws by setting up task force teams in every district, tasked with overseeing employment conditions. These teams, which include District Collectors and Superintendents of Police, aim to strengthen enforcement efforts. Under the Sikkim Labour (Regulation of Employment and Conditions of Service) Act, 2021, all workers, whether part of the organized or unorganized sectors, are required to register with the Labour Department prior to employment in the state.
In the organized sector, employers must register their establishments along with providing monthly worker details. Official records indicate 114 registered establishments employing 18,995 workers. Meanwhile, individual workers entering Sikkim for employment in the unorganized sector must also register, as unregistered work is prohibited.
Upon registration, workers receive a card containing their personal details and proof of identification, which can be obtained at district labour offices, Rangpo, and designated check posts. It’s crucial to note this card isn’t an entry permit or trade license and doesn’t confer residency rights. Foreign nationals, including Nepalese citizens, need to register through the Foreigners’ Registration Office.
Failure to adhere to registration requirements results in a Rs. 2,500 fine, and the Labour Department has the authority to impose penalties. Registration is mandatory upon workers’ arrival in Sikkim and must be renewed by March 31 each year.
Currently, registration is manual, but plans are underway to develop a centralized database and an online registration system via a mobile app and website, aiming to enhance process efficiency and record-keeping.
The department emphasizes that while it sets the minimum wage, market forces determine the maximum wage. Additionally, students are exempt from registration requirements, as they are not classified as workers.
