Breaking: Karnataka High Court Triumphantly Halts Controversial Ban on Ex-Judge P N Desai’s Government Roles
The Karnataka High Court has imposed an interim stay on a November 2024 order from the Ministry of Personnel, Public Grievances and Pensions, which prevented Justice P N Desai from accepting government roles for three years following his retirement. Justice Desai, who was appointed by the state government as a one-man commission to probe the alleged MUDA land scam last July, challenged this decision. Represented by Senior Advocate Udaya Holla, Justice Desai argued that he acknowledged his appointment to the Central Administrative Tribunal on August 14, 2024, but declined the role, having already committed to serve the Karnataka government.
Holla emphasized that candidates must give their consent before appointments are finalized, and if they do not assume their roles within 30 days, officials are required to issue a 15-day notice warning of potential debarment. On Tuesday, a bench led by Justice R Devdas granted an interim stay of the Union ministry’s order, effective until the hearing scheduled for February 6.
The court highlighted that Justice Desai had neither been informed of his selection nor received a notice prior to the debarment order. Moreover, the media had prematurely circulated news of his debarment from further appointments as a judicial member of the Central Administrative Tribunal, despite the lack of formal communication.
