President’s rule in Jammu and Kashmir was officially lifted on Sunday, marking a new chapter for the union territory’s political landscape. This move, announced through a gazette notification by the Union Home Ministry, allows for the establishment of a new government formed by the National Conference-Congress alliance, which triumphed in the recent assembly elections.
Omar Abdullah, vice president of the National Conference, is set to become the new chief minister as the alliance’s chosen leader. The transition from central rule to a locally elected government underscores a significant shift since Jammu and Kashmir was reorganized into a union territory on October 31, 2019, following the abrogation of Article 370. This reorganization also resulted in the bifurcation of the erstwhile state into the union territories of Jammu and Kashmir, and Ladakh.
Central rule had initially been imposed in June 2017, following political instability triggered by the BJP’s withdrawal from the coalition government led by Mehbooba Mufti. This led to a series of extensions under President’s rule due to the inability to restore political order. It is important to note that Article 356 of the Indian Constitution, which allows for President’s rule in states, does not apply to union territories like Jammu and Kashmir.
The revocation of President’s rule is in accordance with Section 73 of the Jammu and Kashmir Reorganisation Act, 2019, which also outlines the administration’s legislative framework. The forthcoming appointment of a chief minister marks the beginning of self-governance under this legal provision, reflecting a pivotal moment for the region’s political autonomy.
