Delhi High Court’s Bold Decision: Deportation Ordered for Foreign National Accused of Heinous Crime
The Delhi High Court has ordered the deportation of an Afghan national found residing in India without a valid visa. The individual was initially arrested for allegedly exploiting a U.S. national both sexually and financially under false promises of marriage. However, the court dismissed the FIR following a settlement between the two parties, citing the complainant’s refusal to support the prosecution. The court noted that continuing with the criminal trial would likely be futile, as the U.S. complainant would not be available to testify. In an order issued on October 9, the court instructed the jail authorities to transfer the accused to the Foreigners Regional Registration Office (FRRO). Originally remanded in police custody in 2017, the accused faced charges of rape, cheating, and various offenses under the Indian Penal Code, Foreigners Act, and Information Technology Act. Investigations revealed his fraudulent activities, including siphoning off $90,000 and deceiving other women by faking his identity.
