Breaking: Gauhati High Court’s Bold Move to Eradicate Illegal Lotteries in Assam | Guwahati News
The Gauhati High Court has instructed the Assam state government to direct all district commissioners (DCs) and Superintendents of Police (SPs) not to authorize any online or offline lotteries, emphasizing the illegality of unauthorized lotteries. The directive comes from a division bench comprising Chief Justice Vijay Bishnoi and Justice N Unni Krishnan Nair. They warned that any illegally organized lotteries should prompt immediate legal action by the district’s SP.
This decision arose during a hearing of a petition by Rupam Borborah, who claimed that illegal lotteries were proliferating in Assam despite the Lotteries Regulation Act of 1998 and the Lottery Regulation Rules of 2010, which stipulate that only the state government has the authority to organize lotteries under specific conditions. The petition criticized certain district commissioners for unlawfully granting permission for such activities.
HK Das, serving as Amicus Curiae in the case, stressed the need for stringent measures, especially as the festive season increases the likelihood of illegal lottery activities. The court has acknowledged the state’s lack of response to the petition thus far and granted them six weeks to file a counter-affidavit detailing measures to curb illegal lotteries.
Despite some DCs filing counter-affidavits, the court seeks a comprehensive answer from the state government. The court’s intervention aims to protect residents from being defrauded by illicit lottery operations, highlighting the necessity of governmental oversight to uphold the law and protect vulnerable populations.
This judicial development underscores the essential role of regulating gambling activities and ensuring that state authorities remain vigilant against unauthorized enterprises.
