The Supreme Court on Friday sent a stern message against dowry and cruelty in marriage, rejecting a petition by a member of the accused family in a 2010 Chhattisgarh dowry-death case and upholding convictions. A two-judge bench of Justices B. V. Nagarathna and Ujjal Bhuyan said insulting a bride and pressuring her family for money after marriage cannot be tolerated and must not continue as social practice.
The case dates to 2010, when a young woman’s body was found tied up in her in-laws’ home within seven years of marriage. Her family alleged that she had been subjected for a long period to demands for cash and a car, and to regular mental and physical abuse in pursuit of dowry. Based on those allegations, investigators charged several members of the husband’s family with dowry death, abetment to suicide and cruelty; lower courts convicted multiple family members, and the Chhattisgarh High Court upheld those convictions.
At the Supreme Court hearing, the petitioner — a member of the accused family — argued that only the provisions for cruelty had been applied and that the evidence was insufficient. The bench was not persuaded. Justice Nagarathna posed a pointed question to the court record: “Why do men marry — to insult the girl and her family?” She added that many families try to financially squeeze a bride’s family after marriage to suppress them, and noted that the accused should consider themselves fortunate that the sentence was only three years. Justice Ujjal Bhuyan expressed dismay that such conduct can come from educated people.
The apex court declined to entertain the challenge to the earlier judgments, effectively affirming the findings of the trial court and the high court. The judges also dismissed arguments about delay in filing complaints, giving greater weight to the pattern of alleged harassment and the convictions already secured.
The ruling comes amid renewed attention to alleged dowry-related violence after the recent death of Twisha Sharma in Bhopal, where her family has levelled serious accusations against her husband and in-laws; all accused in that matter are currently in CBI custody. The Supreme Court’s decision underscores the judiciary’s hard line against dowry extortion and marital cruelty.
