Supreme Court Rejects Petition for Brahmin Hate Speech Recognition
New Delhi: The Supreme Court on Friday declined to entertain a writ petition that sought recognition of alleged hate speech targeting the Brahmin community — described in the petition as “Brahmophobia” — as a punishable form of caste-based discrimination. The bench allowed the petitioner to withdraw the plea, effectively ending the court’s consideration of the matter for now.
A bench comprising Justices B.V. Nagarathna and Ujjal Bhuyan permitted petitioner Mahalingam Balaji, who appeared in person, to withdraw the petition with liberty to approach an appropriate forum. The court recorded Balaji’s request and formally dismissed the writ as withdrawn.
“The petitioner who has appeared in person has sought permission to withdraw this petition. His submission is placed on record. The writ petition is dismissed as withdrawn,” the apex court said in its order. The order therefore records the withdrawal rather than adjudicating the substance of the allegations.
By allowing the withdrawal with liberty to seek other remedies, the court left open the possibility for the petitioner to pursue alternative legal or statutory forums. The brief hearing and dismissal mean the Supreme Court did not issue guidance on whether claims of targeted hate speech against a particular caste group can be treated as caste-based discrimination under existing law.
