Unprecedented Judgments: Marital Rape to Google Antitrust Under India’s Dynamic Chief Justice Sanjiv Khanna
Justice Sanjiv Khanna was sworn in as the 51st Chief Justice of India (CJI) at Rashtrapati Bhavan, Delhi, on Monday. Known for his involvement in critical judgments like those concerning the electoral bonds scheme and the abrogation of Article 370, CJI Khanna will serve a term of six months, in contrast to his predecessor DY Chandrachud’s two-year tenure. During Khanna’s term, several significant cases, poised to have considerable societal impact, are expected to be addressed.
Among the high-profile cases scheduled are Google’s antitrust appeal, the criminalization of marital rape, and issues concerning e-gaming’s retrospective taxation. The Supreme Court will hear Google’s appeal against the National Company Law Appellate Tribunal’s (NCLAT) decision, which upheld a ₹1,338 crore fine imposed by the Competition Commission of India for abusing its dominant position in the Android ecosystem. This hearing, originally set for October, is now expected in January 2024.
Additionally, the much-debated criminalization of marital rape is expected to be revisited by the court in the coming months, following multiple adjournments. The issue remains an essential topic of legal and societal discourse, and its resolution is eagerly anticipated.
Moreover, the court will address challenges from gaming companies against Goods and Services Tax (GST) notices amounting to over ₹1.12 lakh crore, marking another significant docket item on Chief Justice Khanna’s agenda.
With a packed schedule of influential cases, CJI Sanjiv Khanna’s time in office promises to be pivotal, potentially reshaping critical legal landscapes in India.
