Delhi CM Kejriwal Seeks Supreme Court Bail in Excise Policy Scam

Delhi Chief Minister Arvind Kejriwal appeared before the Supreme Court on Thursday, asserting that the Central Bureau of Investigation (CBI) did not arrest him for almost two years in the alleged excise policy scam. Kejriwal’s senior advocate, Abhishek Singhvi, argued that the arrest made on June 26 was only carried out after Kejriwal secured bail in a related money laundering case filed by the Enforcement Directorate (ED).
The bench, consisting of Justices Surya Kant and Ujjal Bhuyan, heard that the CBI did not serve any prior notice to Kejriwal and an ex-parte arrest order was issued by the trial court. Emphasizing Kejriwal’s status as a constitutional functionary and not a flight risk, Singhvi urged the court to grant bail.
Singhvi also highlighted that Kejriwal was not mentioned in the CBI’s FIR and a previous interim bail was granted by the top court, noting that Kejriwal posed no threat to society. He pointed out that the case, which began in August 2023, culminated in Kejriwal’s March arrest for money laundering, despite already being granted bail by both the top and trial courts.
The Supreme Court, on August 23, allowed the CBI to file a counter affidavit and gave Kejriwal two days to file a rejoinder. Kejriwal has filed two separate petitions: one challenging the denial of his bail and another contesting his CBI arrest. He has also challenged the Delhi High Court’s August 5 ruling upholding his arrest.
The high court on August 14 refused interim bail to Kejriwal and sought a response from the probe agency regarding his plea. It further stated that there was no malice in the CBI’s actions and observed how Kejriwal’s arrest might enable witnesses to testify without fear.
The now-scrapped excise policy, which fell under scrutiny in 2022, led to an investigation into alleged irregularities and corruption. The CBI and ED claim that the policy was modified unlawfully, extending undue advantages to specific licence holders.
