Kerala High Court Scrutinizes Hema Committee Report on Sexual Exploitation in Film Industry
A Division Bench of the Kerala High Court, led by Acting Chief Justice A. Muhamed Mustaque and Justice S. Manu, has taken significant steps regarding the Justice K. Hema Committee report, which exposes sexual exploitation and harassment of women in the Malayalam film industry. On August 22, 2024, the court admitted a public interest litigation (PIL) demanding the Kerala government initiate criminal proceedings against the perpetrators.
The Bench emphasized that the court must decide whether criminal action is necessary if the report reveals any cognizable offenses. The court directed the State government to present the entire report for closer examination. Although the government has not yet initiated any action due to the absence of formal complaints, the report’s serious allegations cannot be ignored.
The Hema Committee findings indicate pervasive sexual harassment and exploitation, with the victims preferring anonymity. The court highlighted the importance of addressing protections for these vulnerable women and stressed that the government’s inaction would nullify the committee’s efforts.
Advocate General K. Gopalakrishna Kurup argued there was no indication of cognizable offenses in the report and noted that confidentiality was promised to those who testified. He mentioned that those wishing to prosecute could approach the police or the courts independently and reaffirmed the committee’s role as a study group rather than a judicial commission.
In addition, the Kerala Women’s Commission was named a respondent in the case. Petitioner Navas from Thiruvananthapuram sought the production of the uncensored report and all relevant records, asserting that the report unveiled incidents of sexual molestation, rape, and discrimination. He argued that the State, as the prosecuting authority, has a duty to register suo motu cases if any cognizable offenses are identified.
This development marks a critical juncture in addressing and potentially rectifying the systemic issues faced by women in the Malayalam film industry.
